1. Purpose
This Statement clarifies the professional, legal, and ethical boundaries between CliniciansCheck Ltd ("Platform") and all clinicians, wellness providers, and healthcare professionals ("Practitioners") who operate via the Platform. It affirms that CliniciansCheck does not interfere with, direct, supervise, or control the clinical judgment or patient care decisions of any registered Practitioner.

2. Professional Autonomy
All Practitioners using the Platform are independent professionals responsible for the care, advice, and services they provide. CliniciansCheck does not act as a healthcare provider, does not deliver clinical services, and does not employ or contract Practitioners in a medical capacity.

Practitioners are also expected to operate in accordance with relevant global clinical and ethical frameworks such as the WHO International Code of Medical Ethics and WMA Declaration of Geneva.

3. Scope of Platform Role
CliniciansCheck provides a secure infrastructure for:

  • Profile visibility
  • Appointment scheduling
  • Marketplace listings
  • Ratings and feedback tools
  • Secure messaging and communication
  • The Platform does not:
  • Review or approve clinical decisions
  • Dictate treatment plans or methods
  • Participate in diagnosis or prescription
  • Supervise or monitor clinical interventions

4. Liability and Legal Disclaimer
Practitioners are solely responsible for ensuring that their advice and conduct:

  • Comply with local, national, and international medical laws and regulations
  • Align with their licensure and scope of practice
  • Adhere to evidence-based standards and patient consent obligations
  • CliniciansCheck bears no liability for:
  • Medical negligence or malpractice
  • Adverse patient outcomes
  • Incorrect use of AI tools by Practitioners
  • Misdiagnosis, delay in care, or unlicensed practice

4A. Practitioner Accountability & Oversight
While CliniciansCheck does not interfere with clinical decisions, it reserves the right to suspend or remove Practitioners from the Platform who:

  • Violate patient safety protocols
  • Breach platform terms or code of conduct
  • Are subject to regulatory or criminal investigation
  • Fail to comply with legal or professional obligations

These actions are administrative and do not constitute clinical supervision or medical review.

5. AI Tools and Clinical Judgment
Any AI, decision-support, or co-pilot systems integrated into the Platform are for informational purposes only unless explicitly certified and approved for clinical use under applicable regulations (e.g., MHRA, FDA, UKCA, CE). Final decisions must be made by a qualified human professional.

Practitioners using AI are required to validate outputs, ensure patient understanding, and accept full responsibility for clinical outcomes.

AI systems must meet standards for auditability, explainability, and traceability as set out in applicable laws such as the EU AI Act, the UK NHS AI Code of Conduct, and FDA/CE regulatory frameworks. Practitioners must maintain records of AI-influenced clinical decisions where applicable and be prepared to provide justification during compliance reviews.

6. User Understanding
By using the Platform, patients and users acknowledge that:

  • All care is provided independently by third-party Practitioners
  • CliniciansCheck does not endorse specific treatments or outcomes
  • Any concerns about care must be directed to the Practitioner involved

The Platform is not intended for use in emergency or life-threatening situations. Users in crisis should seek immediate assistance from local emergency services or licensed in-person care. CliniciansCheck disclaims liability for outcomes resulting from misuse of the Platform for urgent medical care.

7. Disputes and Complaints
CliniciansCheck provides a fair and structured Dispute Resolution Mechanism, but does not adjudicate on matters of clinical correctness or malpractice. Serious concerns may be referred to the appropriate regulatory body or medical board in the relevant jurisdiction.

8. Jurisdiction
This Statement operates in accordance with the laws of England and Wales. Where jurisdictional conflict arises, the Practitioner’s local laws and professional obligations take precedence.

9. Amendments
CliniciansCheck may revise this Statement in line with legal, technological, or operational developments. Practitioners will be notified of material changes and must accept updated terms to remain on the Platform.

9A. Global Applicability
This Statement is intended to be enforceable globally. Where specific country laws or medical regulations conflict with this Statement, such laws shall take precedence solely to the extent required by law. All remaining terms shall continue to apply.

10. Practitioner Acknowledgement
By continuing to use the Platform, each Practitioner affirms that they:

Have read and understood this Statement in full;

  • Accept their sole professional and legal responsibility for clinical decisions made through the Platform;
  • Acknowledge that CliniciansCheck neither supervises nor validates any clinical services provided.
