CliniciansCheck Ltd operates as a global health technology platform, and all users, practitioners, and sellers must comply with this Platform’s Terms, Codes, and Agreements, which are drafted in accordance with international best practices and regulatory frameworks including:

  • The laws of England and Wales

  • EU and UK GDPR

  • The EU AI Act, UK NHS AI Code of Conduct, HIPAA, and equivalent global standards

  • The WHO Global Code of Practice

  • The WMA Declaration of Geneva

  • ISO frameworks such as ISO/IEC 27001 and ISO 26000

However, we recognize that certain jurisdictions impose additional or overriding legal requirements. Therefore:

1. Local Law Takes Precedence Where Mandated

Where local, state, or national law explicitly overrides or contradicts a clause in our policies, such local law shall apply, but only to the extent required.

All other provisions of our agreements remain binding and in force.

2. Duty of Local Compliance

Each user, clinician, practitioner, seller, or organization is individually responsible for ensuring that their activity on the CliniciansCheck Platform is compliant with all applicable:

  • Licensing laws

  • Consumer protection regulations

  • Health or medical professional requirements

  • Advertising standards

  • Telehealth or AI use regulations

If in doubt, users must seek professional legal advice within their jurisdiction before using the Platform.

3. Platform Position

CliniciansCheck does not guarantee that its services are lawful or suitable in all countries or regions. We reserve the right to:

  • Restrict or terminate access in countries subject to sanctions, embargoes, or legal conflict

  • Request jurisdiction-specific documentation for practitioners operating in sensitive or high-regulation markets

  • Adapt service availability to comply with future legal requirements or government directives

4. Language & Interpretation

This Statement is written in English. If translated, the English version shall prevail in the event of legal conflict or ambiguity.

5. AI Governance, Cross-Border Use & Digital Tools

CliniciansCheck provides access to digital tools and AI-enhanced systems (including practitioner-facing and user-facing features). Use of these technologies must comply with:

  • The EU AI Act, UK AI White Paper, NHS AI Code of Conduct, and FDA/CE AI software rules

  • Any cross-border data processing and AI deployment laws applicable to the user’s jurisdiction

  • Auditability, explainability, and traceability requirements

Users and Practitioners are responsible for:

  • Ensuring lawful use of AI or automation in their respective locations

  • Informing patients or consumers where AI impacts decision-making

  • Maintaining AI use logs or audit trails where required by law

CliniciansCheck does not permit use of uncertified AI tools in clinical decision-making unless explicitly authorized by a licensed medical professional and permitted under national regulation.

6. Regulatory Engagement & Platform Transparency

CliniciansCheck maintains a proactive stance toward legal and ethical compliance and may:

  • Engage with local and global regulators, including health, data, and AI oversight bodies

  • Cooperate with government audits, court orders, or investigations, while maintaining user confidentiality as far as legally possible

  • Update platform policies and regional access controls to reflect shifts in international law or digital safety protocols

7. Futureproofing & Dynamic Risk Mitigation

CliniciansCheck operates a continuous legal horizon-scanning process. This includes:

  • Monitoring emerging AI, telehealth, and e-commerce regulations

  • Mapping obligations across OECD, G7, Commonwealth, ASEAN, and African Union legal zones

  • Implementing a modular legal infrastructure, allowing this Statement to evolve without fragmenting the global standard

8. Regulatory Filings and Country-Specific Notices

Where required by law, CliniciansCheck may:

  • File platform registration documentation with local digital health, AI, or e-commerce regulators

  • Comply with jurisdiction-specific notification, disclosure, or licensing frameworks

  • Publish official country-specific legal disclaimers or user notices on the Platform

Users in such regions may be subject to additional onboarding requirements or restricted access, depending on regulatory mandates.

Emergency Regulatory Suspension Clause: In the event of a legal or public health emergency, CliniciansCheck reserves the right to suspend services in affected jurisdictions or adjust features in accordance with government orders or emergency protocols.
