This Platform Disclaimer clarifies the role of CliniciansCheck Ltd ("CliniciansCheck", "we", "our", or "the Platform") as a global technology infrastructure provider. It outlines the limits of our liability, the independence of practitioners and sellers, and the responsibilities of users engaging with services or content on the Platform.

2. No Medical, Clinical, or Diagnostic Services

CliniciansCheck is not a medical provider. We do not offer medical advice, diagnosis, or treatment. All clinical, therapeutic, or wellness services accessed through our Platform are delivered by independent professionals, not by CliniciansCheck.

Any health-related content or AI-powered tools on the Platform are for informational purposes only and do not substitute for professional judgment or licensed medical guidance.

3. Independence of Practitioners and Sellers

All clinicians, wellness providers, and sellers on the Platform operate as independent entities. CliniciansCheck does not supervise, direct, or control any clinical, professional, or product-related decision made by these third parties.

Users are responsible for performing their own due diligence when selecting a practitioner or purchasing a product or service.

4. No Endorsement

CliniciansCheck does not endorse or guarantee:

  • The qualifications or licensure of any clinician or seller

  • The efficacy, safety, or accuracy of any treatment or advice

  • Any product, service, or supplement listed on the Platform

  • Ratings, reviews, and testimonials are user-generated and not verified by CliniciansCheck.

5. AI, Automation, and Digital Tools

AI features (including summaries, risk alerts, and messaging tools) offered on the Platform are:

  • Not a substitute for human clinical decision-making

  • Not approved for diagnostic or therapeutic use unless explicitly stated and legally certified

  • Subject to jurisdictional compliance (e.g., EU AI Act, UK AI Code, FDA, CE, or MHRA regulations)

Practitioners are solely responsible for verifying outputs and ensuring legal compliance with AI or automated tools used in care delivery.

6. Limitation of Liability

To the maximum extent permitted by law, CliniciansCheck disclaims all liability for:

  • Clinical decisions, errors, or omissions by third-party providers

  • Adverse outcomes, injury, or loss resulting from platform use

  • Delays, downtimes, or data breaches caused by third-party tools or infrastructure

  • Misuse of AI tools or misinterpretation of informational content

Users accept full risk and responsibility when engaging with any services, practitioners, or tools through the Platform

7. Emergency Medical Situations

The Platform must not be used for emergencies or urgent medical conditions. In case of an emergency, users must contact local emergency services immediately. CliniciansCheck disclaims any liability arising from misuse of the Platform for emergency care.

8. Geographic Limitations and Legal Compliance

While CliniciansCheck operates globally, the Platform may not be lawful in all jurisdictions. Users are responsible for complying with local laws and regulations, including:

  • Medical licensing and telehealth laws

  • Import/export rules for physical goods

  • Data protection, consumer protection, and AI-related legislation

CliniciansCheck reserves the right to restrict access based on regulatory developments, sanctions, or compliance concerns.

9. No Agency or Employment Relationship

Nothing on the Platform constitutes a joint venture, partnership, employment, or agency relationship between CliniciansCheck and any practitioner, seller, or user.

10. Updates and Modifications

CliniciansCheck may update this Disclaimer in response to changes in law, technology, or business operations. Continued use of the Platform constitutes acceptance of any revised terms.

14. Platform Reliability and Continuity Disclaimer

While we strive to ensure continuous availability, the Platform and its tools may be subject to interruptions, scheduled maintenance, or unexpected outages.

CliniciansCheck is not liable for any business, clinical, or patient impact resulting from unavailability, system errors, or delays.

15. Children’s Use & Parental Supervision

The Platform is not intended for direct use by individuals under the age of 16 without the consent and supervision of a parent or guardian.

CliniciansCheck disclaims liability for unauthorized or unsupervised access by minors.

16. Governing Jurisdiction for Disputes

In the event of a dispute, unless otherwise agreed in writing or required by law:

  • This Disclaimer shall be governed by the laws of England and Wales.

  • Disputes may be referred to binding arbitration under the London Court of International Arbitration (LCIA), or another forum as mutually agreed.

Practitioners using AI-enabled features agree to maintain audit logs of AI-influenced clinical interactions when required by law or regulation. These may be requested by regulators, patients, or CliniciansCheck’s compliance team.

Accessibility and Language Availability

CliniciansCheck aims to ensure that platform information is accessible to users with disabilities, and may offer translated disclaimers or content where appropriate. However, the English version will prevail in legal interpretations.

Intellectual Property Notice

All platform software, design elements, and proprietary AI tools are protected by copyright and intellectual property laws. Unauthorized reproduction or reverse-engineering is prohibited.
