CliniciansCheck Patient Terms of Use

1. Introduction
Thank you for choosing CliniciansCheck — a regulated, secure, and future-forward health technology platform. These Terms of Use ("Terms") govern your access to and use of the CliniciansCheck platform, including all websites, applications, services, and content (collectively, the "Platform"). By accessing or using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree, do not access or use the Platform. CliniciansCheck, at its sole discretion and without liability, may modify these Terms at any time to reflect legal, operational, or technical changes.
2. Eligibility
You must be at least 16 years old to access or use the Platform. By using CliniciansCheck, you represent and warrant that you meet this requirement. If you are using the Platform on behalf of another person, you confirm that you have legal authority to bind that person to these Terms.
3. Account Registration and Security

4. Platform Scope and AI Disclosure

CliniciansCheck does not provide medical advice or treatment and is not a healthcare provider.

AI tools used within the platform are designed to enhance, not replace, human decision-making. All AI outputs are reviewed under human oversight where required.

Use of AI is governed by our AI Use Disclosure Statement and is compliant with UK GDPR, HIPAA, and global AI ethics frameworks.
CliniciansCheck adheres to international AI ethical standards including the NHS AI Code of Conduct (UK), UNESCO and OECD AI principles, and emerging global regulatory frameworks such as the EU AI Act. All AI systems undergo human oversight, regular audits, and transparency reviews. AI insights are never a substitute for clinical judgment or licensed medical advice.
While CliniciansCheck performs reasonable due diligence to verify clinician and provider credentials, it does not independently guarantee licensing, certification, insurance, or professional standing. Users are encouraged to verify these credentials directly with the provider or their local regulatory authority.
4A. AI Conversations and Virtual Agent Disclosures
CliniciansCheck uses automated systems, including AI agents such as “Gigi,” to support users in navigating the Platform, booking services, and understanding options. These AI agents:

Are not human and do not provide medical, legal, or financial advice.

Operate based on machine learning models that may reference third-party sources and user inputs.

Are subject to regular auditing and compliance reviews.

Are designed to uphold transparency, safety, fairness, and explainability in line with the EU AI Act, UK DRCF, and other global standards.
Users acknowledge that any reliance on responses from virtual agents is at their own discretion. Human oversight is available and encouraged for any sensitive or critical query.
5. Services, Payments, and Fees

Users may book services or purchase products through our Platform.

All prices and availability are determined by third-party sellers.

Payments are processed via secure, PCI-DSS compliant providers (e.g., Stripe, PayPal).

You agree to pay all applicable charges, including taxes.
CliniciansCheck acts solely as a facilitator and not a party to the contract between users and sellers. Users acknowledge that all transactions are made directly with third-party providers. CliniciansCheck assumes no liability for payment issues, delivery delays, or service deficiencies.
Certain services or products may be subject to taxes, VAT, customs duties, or other third-party fees depending on your location. These are the sole responsibility of the user and not included in the Platform’s pricing unless expressly stated.
6. Cancellations, Disputes, and Refunds

In cases where CliniciansCheck facilitates a resolution, its determination shall be final and binding. However, users agree that legal remedies (if pursued) are to be sought against the seller or provider, not CliniciansCheck.
7. User Responsibilities and Prohibited Conduct
You agree not to:

Engage in fraud, harassment, hate speech, or abusive behavior.

Circumvent, disable, or interfere with platform security features.

Upload or transmit viruses, bots, or other malicious code.
Users must not engage in transactions, share payment information, or disclose personal health data outside the CliniciansCheck Platform. CliniciansCheck is not liable for any fraud, loss, or harm resulting from off-platform communications or payments.
8. Data Protection and Privacy

Your personal data is collected, stored, and processed under the UK GDPR, EU GDPR, HIPAA, CCPA, and applicable global data laws.

Cross-border data transfers are performed under appropriate safeguards, including SCCs and adequacy decisions.

Interactions with AI agents may be logged and used for service improvement, system learning, or fraud prevention, under strict data minimization and anonymization protocols. Personal health data is never used for model training without explicit consent. Users may request access, correction, or deletion of AI-derived data under applicable privacy laws.

AI-generated responses are not verified by clinicians unless expressly stated. Use of AI outputs is informational only and does not establish a duty of care, fiduciary relationship, or professional advisory service.
Emergency Disclaimer CliniciansCheck is not a crisis or emergency response service. If you are experiencing a medical emergency, mental health crisis, or require urgent care, do not use the Platform. Please contact your local emergency services or go to the nearest emergency room immediately.
11. Limitation of Liability
To the fullest extent permitted by law:

CliniciansCheck shall not be liable for any indirect, incidental, or consequential damages.

To the fullest extent permitted by law, CliniciansCheck’s total cumulative liability to you for any claims arising out of or related to your use of the Platform shall not exceed the greater of £10 (ten British pounds sterling) or the total amount paid by you to CliniciansCheck, if any, in the three (3) months preceding the claim.

We shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, data, goodwill, or business interruption. This limitation applies regardless of the cause of action and even if advised of the possibility of such damages.

Nothing in these Terms excludes liability for death or personal injury caused by negligence.
12. Indemnification
You agree to defend, indemnify, and hold harmless CliniciansCheck, its directors, officers, affiliates, and employees from any claims, liabilities, damages, and costs arising out of:

Infringement of any intellectual property or third-party rights.
13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Alternative dispute resolution (ADR) mechanisms, including arbitration and mediation, may be used where applicable.
For users outside the United Kingdom, we may, at our discretion, elect to resolve disputes via the London Court of International Arbitration (LCIA) or other internationally recognized body. Users agree to binding arbitration in such cases. We also reserve the right to initiate proceedings in the user’s local jurisdiction for enforcement or injunctive relief.

CliniciansCheck complies with applicable health, consumer protection, digital, and AI laws in the jurisdictions in which it operates, including but not limited to:

13B. Local Rights and Consumer Protection
These Terms do not override any mandatory rights granted to you by the consumer protection, privacy, or health laws of your local jurisdiction. Where such laws apply and provide greater protection than these Terms, your local rights will prevail to the extent required by law.
Users in Australia, Canada, the EU, and the United States retain all applicable rights under national consumer law, including the right to cancel or withdraw from certain transactions and to lodge complaints with relevant regulatory authorities.
13C. Export Control and Sanctions Compliance
You agree not to use the Platform in violation of any applicable export laws or regulations, including those of the UK, EU, US (OFAC), or UN sanctions. CliniciansCheck reserves the right to deny access to users in restricted regions or engaged in prohibited activities.
14. Modifications

CliniciansCheck reserves the right to modify these Terms at any time.

Changes will be posted with an updated effective date.

Continued use of the Platform after changes constitutes acceptance of the revised Terms.
Where material changes involve automated decision-making, AI systems, or algorithmic features affecting user rights or service outcomes, CliniciansCheck will provide advance notice and an opportunity for users to seek clarification or opt out, where applicable.
