1. Purpose and Scope

1.1 This policy outlines CliniciansCheck’s legal position regarding clinical responsibility, liability boundaries, and jurisdictional recognition across the territories in which we operate or are accessed. 1.2 It ensures that patients, clinicians, regulators, and affiliated organisations understand the allocation of liability and the platform’s role in facilitating connections, not delivering clinical care.

2. Platform Role and Legal Limitation

2.1 CliniciansCheck is a global technology platform that enables users to discover, review, and engage with clinicians and health-related services. 2.2 The platform does not interfere with, direct, or participate in the practice of medicine or healthcare decision-making. 2.3 No part of the platform’s functionality constitutes medical advice, diagnosis, treatment, or clinical endorsement. 2.4 All decisions relating to care, treatment, or clinical action remain solely with the licensed clinician or provider selected by the user.

3. Jurisdictional Compliance and Legal Reference

3.1 CliniciansCheck operates in accordance with applicable local, national, and regional laws governing digital services, data protection, and healthcare regulation. 3.2 We recognise and respect the authority of health regulators and professional bodies including, but not limited to: 3.2.1 The UK General Medical Council (GMC), Care Quality Commission (CQC), and NHS Digital 3.2.2 The US Office for Civil Rights (OCR) under HIPAA, and relevant State Medical Boards 3.2.3 The European Data Protection Authorities (DPA) and national healthcare regulators 3.2.4 The Australian Digital Health Agency (ADHA) and relevant AHPRA licensing entities 3.2.5 India’s National Medical Commission (NMC) and Data Protection Board 3.2.6 Other nationally recognised medical licensing or oversight bodies where the platform is accessed 3.3 However, compliance with these laws does not imply direct clinical accountability for actions taken by users or clinicians on or through the platform.

4. Clinical Liability and Cross-Border Responsibility

4.1 CliniciansCheck assumes no liability for the professional conduct, decisions, or actions of individual clinicians or providers listed on the platform. 4.2 Each clinician is independently licensed, regulated, and responsible for their own practice in accordance with their local laws and professional code of conduct. 4.3 Users who choose to interact with or receive services from listed clinicians do so at their own discretion, subject to the clinician’s own terms and legal responsibilities. 4.4 Cross-border consultations or services initiated through the platform remain under the jurisdiction of the clinician’s licensing body and the patient’s applicable legal framework. 4.5 CliniciansCheck makes no guarantee of legal reciprocity or enforcement between jurisdictions and disclaims liability for clinical disputes arising in foreign territories.

5. Limitation of Legal Recourse

5.1 Any dispute involving clinical decisions, negligence, or breach of care must be addressed directly to the clinician or provider responsible. 5.2 The platform cannot process, intervene in, or provide mediation on issues related to treatment dissatisfaction, malpractice claims, or professional misconduct. 5.3 Where a user believes that a listed clinician has violated professional standards, they are encouraged to contact the relevant licensing or regulatory authority.

6. Platform Safeguards and Dispute Support

6.1 CliniciansCheck performs reasonable checks at the point of onboarding and offers tools for reporting misconduct or flagging unprofessional behaviour. 6.2 However, these tools do not replace statutory disciplinary processes or legal avenues for clinical redress. 6.3 Our Dispute Resolution Mechanism applies only to contractual, technical, or platform-related matters — not clinical disagreements.

7. User Acknowledgement

7.1 By using the platform, users agree that: 7.1.1 CliniciansCheck is not responsible for any medical advice or treatment decisions 7.1.2 Clinical accountability resides entirely with the chosen provider 7.1.3 No cross-border clinical guarantee or malpractice protection is offered by the platform 7.1.4 All services accessed via third-party providers are used at the user's own risk

8. Amendments and Notification

8.1 This policy will be updated in accordance with changes in healthcare law, jurisdictional rulings, or regulatory guidance. 8.2 Users will be notified of material updates through platform notifications or by email.
