1. Purpose and Context
1.1 This framework defines the allocation of legal liability, contractual limitations, and jurisdictional coverage for services accessed or facilitated across borders using the CliniciansCheck platform. 1.2 It clarifies the distinction between the platform’s responsibilities and those of independent providers, vendors, and third parties interacting with global users.
2. Platform Nature and Service Boundaries
2.1 CliniciansCheck is a global connector, not a clinical provider, insurer, healthcare facility, or diagnostic service. 2.2 All healthcare, wellbeing, or professional services accessed through the platform are independently delivered by licensed individuals or organisations. 2.3 Users are responsible for reviewing the qualifications, jurisdictional rights, and service terms of the provider they choose to engage. 2.4 The platform does not assume responsibility for outcomes, delays, costs, harm, or service inconsistencies experienced during or after third-party engagement.
3. Legal Relationship and Disclaimer
3.1 Use of CliniciansCheck does not create a fiduciary, agency, or medical relationship between the platform and the user, provider, or any other party. 3.2 No warranties or representations are made about the fitness, licensure, or adequacy of a listed individual or organisation unless explicitly stated through verified badge mechanisms. 3.3 The platform disclaims liability for: 3.3.1 Cross-border service disputes involving differences in legal standards 3.3.2 Claims relating to non-delivery, misdiagnosis, late intervention, or unexpected outcomes 3.3.3 Variations in scope of practice or legal recognition between jurisdictions
4. Localisation and Jurisdictional Awareness
4.1 Providers are required to comply with their local laws and not present themselves as licensed or insured in jurisdictions where they are not authorised. 4.2 Users are encouraged to verify whether a provider’s jurisdiction permits or restricts cross-border consultations or services. 4.3 The platform offers location-disclosure tools and guidance, but ultimate responsibility rests with the provider and the user. 4.4 Services offered or advertised in breach of territorial law may result in suspension or reporting to appropriate regulatory bodies.
5. User and Provider Liability
5.1 Users who act on platform content or clinician suggestions without formal consultation do so at their own risk. 5.2 CliniciansCheck is not responsible for private communications, advice given off-platform, or informal relationships established through its services. 5.3 Providers are individually liable for insurance, taxation, recordkeeping, and legal accountability in their operational jurisdiction. 5.4 The platform will cooperate with valid legal, regulatory, or court requests for disclosure if required under applicable law.
6. No International Indemnification or Guarantee
6.1 CliniciansCheck does not offer or guarantee indemnity for claims made across jurisdictions or between users and providers in different legal systems. 6.2 No enforcement of foreign rulings, judgments, or liability findings is facilitated through the platform. 6.3 Legal recourse is subject to local enforceability and international treaties — users are advised to consult legal counsel in their jurisdiction if unsure.
7. Dispute Resolution Scope
7.1 The platform’s Dispute Resolution Mechanism applies solely to matters involving contractual or usage issues directly related to platform terms. 7.2 Cross-border claims related to service quality, malpractice, or financial restitution must be raised with the service provider or applicable regulatory authority.
8. Modification and Legal Evolution
8.1 This framework is reviewed annually and updated to reflect new legal interpretations, regulatory guidelines, and cross-border case law. 8.2 Any major changes will be communicated via platform channels and email.
