1. Purpose

This framework establishes a formal, transparent, and internationally recognized process for resolving disputes that arise between CliniciansCheck, its users, clinicians, vendors, and institutional partners. It ensures fairness, accountability, and legal compliance across all jurisdictions in which we operate.

2. Scope

Applies to:

  • Platform users, clinicians, sellers, buyers, and enterprise clients;

  • Disputes arising from service delivery, platform usage, contract violations, or regulatory interpretation;

  • Global regions where CliniciansCheck operates or has users.

3. Jurisdictional Recognition & Legal Foundations

CliniciansCheck’s dispute resolution process is designed to comply with:

  • UN Convention on International Settlement Agreements (Singapore Convention)

  • UNCITRAL Model Law on International Commercial Arbitration

  • EU Brussels I Recast Regulation

  • UK Arbitration Act 1996

  • US Federal Arbitration Act (FAA)

  • ICC (International Chamber of Commerce) Arbitration Rules

  • WIPO Mediation and Arbitration Rules

  • Local consumer protection and e-commerce laws in each jurisdiction

4. Dispute Resolution Tiers

Tier 1: Informal Resolution We encourage parties to resolve disputes through direct dialogue with our Customer Support or Legal & Compliance team. Most issues are resolved within 14 business days.

Tier 2: Internal Escalation If no resolution is reached, the case is escalated to CliniciansCheck’s senior Legal Counsel. A written response and recommendation is issued within 21 business days.

Tier 3: Mediation CliniciansCheck offers neutral third-party mediation services via globally recognized bodies (e.g., WIPO, ICC Mediation Centre). Participation is voluntary but strongly encouraged.

Tier 4: Arbitration Where necessary, final binding arbitration is conducted in accordance with:

  • The ICC or WIPO arbitration rules;

  • In the English language unless agreed otherwise;

  • In the jurisdiction where the contract originated or the user resides.

Tier 5: Local Court Jurisdiction Only if arbitration is not enforceable or applicable under law, local courts may be used with written consent from both parties.

5. Key Principles

Neutrality: Independent arbitrators with sector expertise;

Confidentiality: All proceedings are private unless disclosure is legally mandated;

Finality: Arbitration rulings are binding and enforceable globally;

Cost Allocation: Each party bears its own legal costs unless otherwise decided by the arbitrator.

6. Consumer & SME Protections

  • All consumer disputes are handled in line with local consumer laws;

  • SME partners may opt out of arbitration within 30 days of onboarding by written notice;

  • Vulnerable users and underrepresented groups receive tailored support throughout the process.

7. Changes & Reviews

This framework is reviewed annually and updated in line with international best practices and evolving legal standards.
